Privacy Policy

This Privacy Policy governs the use of the services (“Services”) provided by Juice Works Sdn. Bhd. (herein referred to as “We” or “Our” or “Us” or “Juice Works”) whether jointly or by itself. Such Services include, but not limited to our mobile application (“Juice Works Mobile App”), our loyalty program (“Loyalty Programme”) and our online portal www.juiceworks.com.my (“Portal”).

By submitting such personal information, we will be processing the personal information provided by you or any third parties and/or further information and data that may be required by us from time to time.

1. Collection of Information
  1. We collect personal information when you:
    1. use the Services to register as a member of our loyalty programme or as a user of the Juice Works Mobile App,
    2. provide comments or submit any inquiry to us,
    3. request information from us and when you provide your name or return contact information,
    4. join any contests or surveys organised by us.
  2. We may process personal information such as:
    1. your name, identity card number, date of birth, gender, phone number, mobile number, postal address and e-mail address,
    2. information about what you purchase, from which Juice Works outlet you purchase from, the frequency of your purchases, any rewards you earn and rewards redeemed through our loyalty programme will be collected,
    3. information relating to our loyalty programme such as your credit card number, transaction number, loading value, redemption value, balance transfer, and balance inquiries, and your activities in our loyalty program,
    4. information generated from your participation in our surveys or any interaction with us in various other ways, such as demographic information, your comments, feedback, questions or suggestions and information about a subject that may be of interest to you, and
    5. information such as your device ID, your location, and stores near you, and visited by you when you use the Juice Works Mobile App.
  3. Your personal details and contact details are obligatory and if you fail to provide such information, we may not be able to provide you with the Services. We may also process other personal information such as:-
    1. your activities through the portal,
    2. transactional history in order to document a transaction you may have had with us; and
    3. information collected through the use of Cookies (as defined below).
  4. Some of the information collected by us may not be explicitly submitted by you as we also automatically receive and record information on our server logs from your browser, including your IP address, cookie information, the web pages you request, your browser type and language, access times, and the referring web site address.
  5. If you give us information about another person, you confirm that the other person has appointed you to act on his/her behalf and has agreed that you can:
    1. give consent on his/her behalf to the processing of his/her personal information;
    2. receive on his/her behalf any data protection notices; and
    3. warrant that you have obtained his/her consent for us to store his/her personal information or have the right to allow us to process his/her personal information.
2. Cookies & Web Beacons
  • “Cookies” are data files that may be downloaded to your computer when you visit the Portal and permit the Portal to identify your browser whenever you interact with the Portal. We use cookies to recognize repeat visits by users of the Portal and to collect information about our users’ interactions with the Portal. These cookies contain identification information that enables us to streamline your experiences when using the Portal. You may set your browser software to reject cookies, but you may not be able to optimize the features of the Portal. In some cases, you may not be able to access the Portal if cookies are disabled.

    We may also use small pieces of code called “web beacons” or “clear gifs” to collect anonymous and aggregate advertising metrics, such as counting page views, promotion views, or advertising responses. A web beacon is an electronic image called a single-pixel or clear GIF. Web beacons can recognize certain types of information, such as a user’s cookie number, time and date of a page view, and description of the page where the web beacon is placed. These web beacons may be used to deliver cookies that conform to our cookie policy.
3. Use of Personal Information
  • In general, other than providing you with the Services and other services incidental or related to the Services, we may use the information provided to us for the following purposes:-
  1. process and manage the use of the Services and/or your purchase and use of a Juice Works products and services;
  2. respond to your inquiries, post your comments or statements on any blog or other online forum including any social media maintained by us or take other action in response to your inquiries or other website activities;
  3. create personalized promotions by combining your personal information with non-personal information about you such as the amounts and types of purchases you make or any benefits you receive through our loyalty programmes and campaigns;
  4. provide, maintain, protect and improve the Services, to develop new services, and to protect ourselves and our users;
  5. verify your eligibility and deliver prizes in connection with any contests and giveaways that the Services may have;
  6. enforce any Terms of Use between us;
  7. research purposes including historical and statistical purposes;
  8. general operation and maintenance of the Portal including audit and its related portal(s);
  9. provide you with regular updates (other than direct marketing materials) from us relating to the Services; and
  10. investigation of complaints, suspected suspicious transactions and research for improvement of services.
4. Disclosure & Personal Information
  1. We may share your personal information with:-
    1. our franchisees, subsidiaries, parent and other affiliated companies for the purpose of developing or marketing new products, services or portals that are developed by our related companies and informing you of such new products, services or portals;
    2. service providers under contract who help with our business operations (such as merchants, partners, fraud investigations, bill collection, monitoring of user behavior and the processing of payments for any products or services);
    3. third parties (including those overseas) who provide data processing services; and
    4. any person or persons, who is under a duty of confidentiality to which has undertaken to keep such data confidential, which we have engaged to fulfill our obligations to you.
  2. We may disclose your personal information if required to do so by law or if we have good faith and belief that such disclosure is necessary to protect and/or defend our rights and interests. We may, as permitted by applicable law, disclose your personal information to third parties in connection with an investigation of fraud, infringement, piracy, tax avoidance and evasion, or other unlawful activity, and you expressly authorize us to make such disclosures.
  3. If we are merged or acquired by another entity, personal information may be transferred to such entity as a part of the merger or acquisition.
5. General
  • Any changes to this privacy policy in any way will be updated on this page. Regular reviewing of this privacy policy will ensure that you are updated on the information which is collected, how it is used, and under what circumstance, if
    any, it is shared with any other party.

Terms of Use

The terms and conditions of this Agreement govern your registration to the Juice Works Loyalty Programme operated by Juice Works Sdn. Bhd. (Company No. 653358-A) of No. 5 Jalan SS 4C/5, Taman Rasa Sayang, 47301 Petaling Jaya, Selangor Darul Ehsan, Malaysia (herein referred to as “We” or “Our” or “Us” or “Juice Works”).

1. Registration as User
  • Upon registering yourself as a user of our Juice Works Loyalty Programme, you will enjoy the various benefits offered by Juice Works which may change from time to time. Each benefit may be subject to additional terms and conditions. All references are to Juice Works outlets in Malaysia.

    To register as a user, you must be age 18 and above and is a resident in Malaysia. Proof of age may be required before we accept the registration of membership and all information provided by you to us is based on reasonable assumption and that all information given are true and not misleading.

    Our loyalty program will not expire subject to the terms and conditions of this Agreement. This membership is only limited for use in Malaysia. This membership is not transferable.
2. Juice Works e-Wallet Program
  • Our Juice Works e-Wallet Program “e-Wallet” allows you to load a monetary value on to your Juice Works Mobile App. The e-Wallet value can be used to make any drink purchases or any prescribed items at any Juice Works outlets in Malaysia. The credit balance in your e-Wallet is to be treated like cash. It cannot be replaced if lost, stolen or damaged, unless you have registered it and reported the loss as required below. The monetary value that you load onto your e-Wallet is a top up value only for the beverages/items sold in Juice Works outlets in Malaysia. No credit card, credit line, overdraft protection or deposit account is associated with Juice Works. No interest, dividends or any other earnings on funds loaded on to your e-Wallet will accrue or be paid or credited to you by us. The value associated with the e-Wallet is not insured or guaranteed by any person or entity.

    You can load value onto your e-Wallet by using cash and/or credit card at any Juice Works outlets in Malaysia, or by personal online banking.

    The minimum amount that can be loaded into your e-Wallet for the first time is RM10.00. A maximum amount of RM300.00 is permitted into your e-Wallet at any given time and the amount that can be reloaded each time must be in denominations of RM10.00. We may change these maximum and minimum amounts at any time by notifying you at the point of sale or on our Juice Works Mobile App or via www.juiceworks.com.my (“Juice Works Website”) and such change shall constitute an amendment to this Agreement. All sums loaded on the e-Wallet is not refundable unless stated otherwise in this Agreement.
3. Fees and Expiry Date
  • We do not charge any fees for the issuance, activation, use or reloading of your Juice Works App and e-Wallet. Your e-Wallet will automatically expire if not used within three (3) years after the last top up or transaction. However, we will send a reminder notice for you to utilise the credit balance of your e-Wallet and should there still be no recorded usage of your e-Wallet, the unutilised credit balance will be forfeited in the event this Agreement is terminated due to fault of your own or by negligence.
4. Receipts and Statements
  • No statements will be issued for itemised transactions from the use of your Juice Works Mobile App. You may check your e-Wallet balance or review the latest transactions on your Juice Works Mobile App. You are advised to keep your receipts and check your purchases via our Juice Works Mobile App to ensure that your account balance is correct at all times.
5. Redemption
  • The Stored Value cannot be exchanged or redeemed for cash and any credit balance is not transferable. All reward benefits are valid only within their stipulated periods.
6. Complaint Handling
  • We reserve the right to correct the balance of your e-Wallet if we believe that a clerical, billing, or an accounting error has occurred. If you have questions regarding your transaction history or any correction, or if you dispute any transaction or correction that has been charged to your e-Wallet, please contact our Info Centre by calling 03-78049333 and we will conduct an investigation. Our Info Centre will investigate, communicate the results, and/or correct any error if found to be genuine as soon as our investigation is completed and final. Juice Works will not be liable for any billing error unless you provide us written notice within fifteen (15) days of the date you become aware of such error. You are advised to monitor your transactions and account balances closely at all times.
7. Optional Registration; Liability for Unauthorised Transactions
  • As your Juice Works App is used like cash for purchases from Juice Works, you are responsible for all transactions associated with your e-Wallet, including unauthorized transactions. There is strictly no replacements for lost, stolen,
    damaged or misused Juice Works Mobile App on your mobile device.

    However, for registered Juice Works Mobile App users, the e-Wallet can be deactivated by contacting Info Centre by telephone on 03-78049333 or via email at info@juiceworks.com.my to report on temporary suspension of your App. We will only then suspend your e-Wallet usage.

    You are required to activate a new Juice Works Mobile App after the deactivation of your last Juice Works Mobile App. We will replace only the balance credit from your e-Wallet from the time of deactivation onto your newly created
    e-Wallet. Your e-Wallet balance is only protected from the point in time whereby your report is submitted and only after acknowledgement from Juice Works.

    Please notify us immediately if there is any change of personal information provided during registration. If your registered Juice Works Mobile App is lost, stolen or damaged, you should contact Juice Works immediately at 03-78049333 or by email to info@juiceworks.com.my.
8. Privacy
  • When you subscribe to our Juice Works Mobile App and e-Wallet Program, we will collect, store and use certain information as described in our Privacy Policy (available at our Juice Works website). You hereby agree to the said Privacy Policy as well as the Terms of Use.
9. Marketing
  • We will periodically send you information containing advertisements and current promotions. If you wish not to receive such information, please click on the unsubscribe button.
10. Indemnification
  • You shall hold us harmless and indemnify us against any liability for loss, damage, costs and expenses (legal or otherwise including all costs on a solicitor and client basis) which we may incur by reason of the provisions herein or in the enforcement of our rights hereunder.
11. Termination
  • We reserve the right to terminate this Agreement with immediate effect if:
  1. you have breached the terms and conditions of this Agreement or any agreements with us;
  2. your registration with our Juice Works Mobile App and Loyalty Program is suspended, terminated and/or expired; or
  3. Juice Works decides to end the Juice Works Mobile App and Loyalty programme.
  • Should Juice Works decide to end this Juice Works Mobile App and Loyalty Programme or the e-Wallet Programme, we will refund you any unutilised credit in your e-Wallet on the condition that you have provided us with sufficient details to make the refund. Such refund will be made within thirty (30) days from the date of notification to us and provided that such unutilised e-Wallet balance has a minimum value of RM5.00. Any unclaimed e-Wallet balance or unutilised e-Wallet that is not requested for refund within 30 days will be forfeited. We also reserve the right to deduct administrative charges of RM10.00 from the refundable sum before any refund is made to you.

    We may also suspend this Juice Works Mobile App or e-Wallet Programme for any indefinite period at any time by giving notice via our Juice Works Mobile App, or by any other means of publication such as electronic means or even by notices posted at our Juice Works outlets.

    For the avoidance of doubt, cancellation, termination or suspension by us of this Juice Works Mobile App, the Loyalty Programme or the e-Wallet Programme shall not entitle you to any claim or compensation against us for any loss or
    damage suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.

    In the event you request to refund due to your cancellation of the Juice Works App and Juice Works Loyalty Programme, we will refund any credit balance in the e-Wallet or unutilised e-Wallet balance within fifteen (15) days to your nominated personal bank account within Malaysia. We also reserve the right to deduct administrative fee or charges of RM10.00 from the refundable sum before any refund is made to you.
12. No Liability
  • We are not liable for:
  1. any loss of income, business, goodwill or profits arising from this Agreement or from the use of our Juice Works Mobile App, Juice Works Loyalty Programme and e-Wallet Programme;
  2. any unauthorized access to or alteration, theft or destruction of the Juice Works Mobile App, Juice Works Loyalty Programme and e-Wallet Programme;
  3. the consequences of any delay or mistake relating to the use of Juice Works Mobile App, Juice Works Loyalty Programme and e-Wallet Programme caused by any circumstances beyond our control;
  4. any loss or damage which was not caused by our breach of this Agreement or breach of legal duty or care;
  5. any loss or damage which was not a reasonably foreseeable result of either by our breach of this Agreement or breach of legal duty of care. Loss or damage is “reasonably foreseeable” if at the time this Agreement is entered, such loss was contemplated by you and by us; or
  6. any loss or damage suffered by you as a result of your failure to take reasonable precautions against such loss or damage.
13. Governing Law and Jurisdiction
  • This Agreement is governed by the laws of Malaysia. You irrevocably consent to the exclusive jurisdiction of the courts of Malaysia for purposes of any legal action arising out of or related to this Agreement.
14. Changes
  • We reserve the right to change or modify this Agreement or any other Juice Works Sdn. Bhd. policies related to the Juice Works Mobile App, Juice Works Loyalty Programme and e-Wallet Programme at any time and at its sole discretion by posting revisions on the Juice Works Website and Juice Works Mobile App. Continued use of the Juice Works Mobile App, Juice Works Loyalty Programme and e-Wallet Programme following the posting of these changes or modifications will constitute acceptance of such changes or modifications.
15. Severability
  • If any provision of this Agreement shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
16. Assignment
  • We may transfer all or part of this Agreement without such transfer being considered a change to this Agreement, by giving notice to you. The company or other entity to whom we transfer this Agreement to will have the same rights and obligations as we did before the transfer and we will ensure that the company or entity agrees in writing to be bound by the terms and conditions of this Agreement so that your rights under this Agreement are not detrimentally affected.
17. Entire Agreement and Construction
  • All correspondence entered into under this Agreement will be in the English language. This Agreement is the complete and exclusive statement of the Agreement between you and Juice Works Sdn. Bhd. and supersedes all prior proposals and all other agreements in respect of the subject matter of this agreement. If any provision of this Agreement is illegal or unenforceable, that provision will be deleted from this Agreement, and the remaining terms will not be affected. Headings are for convenience of reference only and will in no way affect interpretation of this Agreement.
